3. Purchase, Payment, Shipping, and Delivery

  • Pricing and Payment: All prices displayed on the Website are in Canadian dollars and are subject to change without notice. You agree to pay the price indicated for products at the time of purchase, as well as any applicable sales taxes and shipping fees. We accept payment by major credit cards, Shop Pay, Google Pay, Apple Pay, PayPal, and others. By submitting your payment information, you authorize us (or our third-party payment processors) to charge the applicable amount.

  • Shipping and Delivery (Dropshipping): We utilize a dropshipping model, meaning that the toys you purchase will be shipped directly to you from our suppliers, primarily located in China. Please be aware that shipping times may be longer than for domestic shipments. Estimated delivery times will be approximately 20 business days from the date of purchase, but these are estimates only and are not guaranteed. You acknowledge that there may be non-refundable costs including additional customs duties, import taxes, or brokerage fees that are your sole responsibility and may be collected upon delivery.

  • Refunds, Returns, and Exchanges:Our refund, return, and exchange policy is outlined on our Refund/Return Policy page. Please review this policy carefully before making a purchase.

  • Order Acceptance:Your placement of an order does not necessarily guarantee acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity. If we cancel your order, we will notify you and issue a refund if payment has been processed.

4. Product Information, Disclaimers, and Age Grading

As the retailer, we are committed to offering products that meet Canadian safety standards for children's toys. As such, we undertake reasonable efforts to vet our suppliers and request ISO and other safety compliance documentation; however, you acknowledge that the ultimate responsibility for product safety lies with manufacturers and with your. Health Canada retains the authority to order recalls of any products deemed to be unsafe.
  • Accuracy of Product Descriptions:We strive to provide accurate and up-to-date product descriptions on our Website. However, we do not warrant that the descriptions, images, pricing, or other content are error-free. If you receive a product that does not conform to its description, your sole remedy is to return it in unused condition in accordance with our return policy.

  • General Product Disclaimer: Please note that product packaging and accompanying materials may contain more or different information than what is displayed on our Website, including but not limited to country of origin, specific warnings, and assembly instructions. While we take reasonable steps to ensure the safety and quality of the toys we sell, we provide our products on an “as-is” and “as-available” basis. You acknowledge that we utilize a dropshipping model and do not directly manufacture or control the manufacturing process of these products. Therefore, to the extent permitted by law, we do not make, and we hereby expressly disclaim, any express or implied warranties, representations, or endorsements whatsoever, including liability for defects or safety issues arising from the manufacturing process, implied warranties of merchantability or fitness for a particular purpose. This does not affect your statutory rights.

  • Specific Warnings for Children's Toys:
    • Warning Labels: You are advised to always read labels, warnings, and directions provided with the product before use.

    • Parental Supervision:Adult supervision is strongly recommended for the use of all toys purchased from our Website. Toys can present choking hazards due to small parts, and sharp edges or points may cause injury during play. Parental judgement in the ability and context of play is advised to ensure safe use of all toys.

    • Age Grading: Please carefully review the recommended age grading provided for each toy. Some toys may contain small parts that could pose a choking hazard for children under a certain age (typically under 3 years). Please keep such toys away from younger children. It is the sole responsibility of the parent or legal guardian to determine the suitability of a toy for their child's age and developmental stage and to provide appropriate supervision during use of the toy.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Little Makers and its affiliates, officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, attorneys’ fees or other intangible losses) arising out of or relating to your use of the Website or any products purchased through the Website, even if we have been advised of the possibility of such losses. If the law restricts us from disclaiming responsibility in this manner, our total liability to you for any claim arising out of or relating to the Website or to our products shall not exceed the amount of CAD $1.00.

6. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Little Makers or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Website without our prior written consent.
You agree not to infringe upon our intellectual property rights or the intellectual property rights of our suppliers or to aid or incite others to do so.

7. Dispute Resolution and Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Website shall be brought exclusively in the courts located in the Greater Toronto Area, Canada. You agree to waive trial by jury in any action.

8. Indemnification

You agree to indemnify, defend, release, and hold harmless Little Makers and its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all damages, injuries (including death), costs, expenses, fees (including attorney fees) arising out of or relating to (a) use of our products contrary to any use information, warning labels or directions provided in connection with a particular product; (b) your breach of these Terms of Use; or (c) your use of the Website.

9. Changes to These Terms

We reserve the right to modify or revise these Terms of Use at any time without notice. By continuing to use the Website after any such changes, you agree to be bound by the revised Terms. It is your responsibility to review these Terms periodically for updates.
